Terms and Conditions (T&Cs) for B-Trader Journal

1. Scope
These Terms and Conditions (T&Cs) apply to the use of the online software "B-Trader Journal" (hereinafter "Software") by consumers within the meaning of Section 13 German Civil Code (BGB). The provider of the Software is Bjorn Liffers, trading under the name "B-Trader Journal", hereinafter "Provider".
2. Subject matter of the contract
The Provider supplies the user with a cloud-based software solution that enables keeping a trading journal, automatic trade evaluation, KPI calculation, and analysis based on the BAPA model.
The Software is provided exclusively online (Software-as-a-Service). No installation takes place on the user side.
3. Registration and user account
A user account is required to use the Software. The user is obliged to provide truthful information during registration and to keep access credentials confidential.
4. Trial period and withdrawal
The Provider grants new users a 1-month free trial period without requiring payment details.
No costs arise during the trial period.
Withdrawal:
As the user can start using the Software immediately after registration, the statutory right of
withdrawal expires in accordance with Section 356(5) German Civil Code (BGB) at the start of
the trial period.
The user confirms this by activating the checkbox:
"I agree that the trial starts immediately and that my right of withdrawal expires."
5. Contract term and termination
After the trial period, the user may purchase a paid subscription.
- Monthly subscription: term of 1 month, cancellable at the end of the current month.
- Annual subscription: term of 12 months, cancellable at the end of the term.
Cancellation is possible via user account or by email to the Provider.
6. Prices and payment
Applicable prices are displayed on the Provider's website. Billing is processed via PayPal. Payment is due at the beginning of each billing period.
7. Scope of services
The Provider offers the following features:
- Capture and management of trades
- Automatic KPI calculation
- BAPA analysis
- Upload of screenshots and notes
- Statistical evaluations
- Personal trading history
The scope of features may be further developed and expanded.
8. Availability
The Provider strives for high availability of the Software but cannot guarantee uninterrupted accessibility. Planned maintenance work will be announced in advance where possible.
9. User obligations
The user undertakes to:
- not upload unlawful content
- not misuse the Software
- not carry out automated attacks or manipulations
- not circumvent security-related measures
10. Usage rights
The user receives a simple, non-transferable, non-sublicensable right of use for the Software for the duration of the subscription.
11. Liability
11.1 No financial advice
The Software does not constitute investment advice, trading recommendations, signals, or an invitation to buy or sell financial instruments. The Provider is not liable for losses resulting from the user's trading decisions.
11.2 Exclusion of economic damages
The Provider is not liable for:
- lost profits
- losses from securities or derivatives trading
- financial losses
- wrong decisions by the user
- incorrect or incomplete user inputs
- interpretations of provided evaluations
11.3 Liability for intent and gross negligence
The Provider is liable without limitation only for damages caused by intent or gross negligence. This is mandatory under applicable law.
11.4 Liability for slight negligence
In cases of slight negligence, the Provider is liable only for breach of essential contractual obligations (cardinal obligations), and only limited to the foreseeable, typical contractual damage.
11.5 No liability for data loss outside the Provider's control
The Provider is not liable for data loss caused by:
- outages of third parties (PayPal, hosting provider, cloud services)
- user device or software errors
- browser or operating system problems
- the user's internet connection
11.6 Availability
The Provider does not guarantee any specific availability of the Software.
11.7 Personal injury
Statutory liability for personal injury remains unaffected.
12. Data protection
The Provider processes personal data exclusively in accordance with GDPR. A separate privacy policy informs about type, scope, and purpose of data processing.
13. Termination and data deletion
After cancellation or expiry of the subscription, the user account is deactivated. The user may request deletion of their data at any time.
14. Amendments to the T&Cs
The Provider may amend these T&Cs where legitimate interests exist and the user is not unreasonably disadvantaged. Amendments are communicated to the user by email.
15. Final provisions
German law applies. Should any provision of these T&Cs be invalid, the validity of the remaining provisions remains unaffected.
